• Be at least 18 years of age, or have parental/guardian consent if between 13-17 years old
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Services under applicable laws
• Provide accurate and complete registration information
• Be a resident of South Africa or a jurisdiction where our Services are available

Mind Heavenly offers:

• Therapy Sessions: Video, audio, and text-based sessions with licensed therapists
• AI Support: 24/7 AI-powered mental wellness support and guidance
• Resources: Educational content, exercises, and self-help materials
• Progress Tracking: Tools to monitor your mental wellness journey

Our therapists are independently licensed professionals. Mind Heavenly facilitates connections but does not directly provide medical or therapeutic services.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your contact information remains accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

6. Therapy Services

When using our therapy services:

• Sessions are conducted by independently licensed mental health professionals
• The therapist-client relationship is between you and your chosen therapist
• You have the right to discontinue services at any time
• Session content is confidential, subject to legal exceptions
• Therapists may terminate the relationship if they believe they cannot adequately help you

7. AI Support Services

Our AI-powered support:

• Is designed to provide general wellness support and guidance
• Is NOT a replacement for professional therapy or medical advice
• May not be suitable for all mental health conditions
• Will escalate to human support when crisis indicators are detected
• Conversations may be reviewed to improve service quality

8. Payment and Cancellation

Payment terms:

• Fees are charged as specified at the time of booking
• Payment is due at the time of booking or as agreed
• Cancellations made less than 24 hours before a session may incur fees
• No-shows may be charged the full session fee
• Refunds are processed according to our refund policy

You agree not to:

• Provide false or misleading information
• Use the Services for any unlawful purpose
• Harass, threaten, or abuse therapists or staff
• Share your account credentials with others
• Record sessions without explicit consent from all parties
• Attempt to circumvent security measures
• Use the platform for commercial purposes without authorization

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, and software, are the exclusive property of Mind Heavenly and are protected by copyright, trademark, and other intellectual property laws.

To the maximum extent permitted by law, Mind Heavenly and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Services.

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
